Accepting These Terms
This document and the other documents we reference below make up our house rules, officially called our Terms of Use(the “Terms” for short). These Terms are a legally binding contract between you and Tribal Minds, Inc. (“Tribal Minds”). If you live in the Americas or elsewhere, the contract is between you and Tribal Minds, Inc., a Native-led nonprofit incorporated in Nevada.
Please note: Section 11. Disputes with Tribal Minds, Inc. contains an arbitration clause and class action waiver. By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration. This means you waive your right to a judge or jury trial, and you waive your right to participate in class actions, class arbitrations, or representative actions.
This contract sets out your rights and responsibilities when you use tribalminds.org, our mobile apps, online programming, governance trainings, cultural and ceremonial offerings, Indigenous language programs, in-person community experiences, and any other services provided by Tribal Minds (collectively, the “Services”). By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree, you may not use our Services.

Your Privacy
Your privacy matters. Our Privacy Policy explains how your information is collected, stored, and used when you engage with our Services. By using our Services, you agree to how we process information as set forth in the Privacy Policy.
Where applicable, you may also be bound by third-party privacy rules (for example, vendors, affiliates, or event partners). You agree to indemnify Tribal Minds if your actions cause us liability under joint data controller rules.
Your Account with Tribal Minds
Your Content
Anything you post through our Services is Your Content. You remain its owner, but you grant Tribal Minds a broad license to use, display, and distribute it as needed to provide Services and promote our mission.
By posting Your Content, you grant Tribal Minds a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, modify, distribute, and display it across media channels. This includes cultural materials (songs, images, prayers, or language recordings) that you voluntarily share.
You are solely responsible for Your Content and agree not to post anything infringing, harmful, abusive, false, or misleading.
Your Use of Our Services
You are granted a limited, non-exclusive, revocable license to use our Services. In exchange, you agree:
Termination
Warranties and Limitation of Liability
Tribal Minds offers Services “as is.” We make no warranties or guarantees about results, outcomes, or availability.
This includes:
Tribal Minds, its officers, staff, cultural practitioners, and affiliates are not liable for damages (direct, indirect, incidental, or consequential) exceeding $100 or the amount you paid in the past 12 months, whichever is greater.
Indemnification (or What Happens If You Get Us Sued)
If your actions (online or in-person) cause Tribal Minds to be sued, you agree to indemnify and hold us harmless. This includes but is not limited to: misuse of ceremonies, misrepresentation of cultural knowledge, intellectual property claims, or violations of law.
Disputes with Tribal Minds
Any disputes will be governed by Nevada law and resolved through binding arbitration in Washoe County, Nevada (unless otherwise specified). Class actions and representative claims are waived.
Changes to the Terms
We may update these Terms from time to time. Continued use of Services after updates means you accept the changes.
