Welcome to Tribal Minds, Inc. We’re so glad you’re here. Make yourself comfortable and have a good time, but please follow our house rules.

By using the Services, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Use. If you do not agree, please discontinue use of the Services.

Accepting These Terms

This document and the other documents we reference below make up our house rules, officially called our Terms of Use(the “Terms” for short). These Terms are a legally binding contract between you and Tribal Minds, Inc. (“Tribal Minds”). If you live in the Americas or elsewhere, the contract is between you and Tribal Minds, Inc., a Native-led nonprofit incorporated in Nevada.

Please note: Section 11. Disputes with Tribal Minds, Inc. contains an arbitration clause and class action waiver. By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration. This means you waive your right to a judge or jury trial, and you waive your right to participate in class actions, class arbitrations, or representative actions.

This contract sets out your rights and responsibilities when you use tribalminds.org, our mobile apps, online programming, governance trainings, cultural and ceremonial offerings, Indigenous language programs, in-person community experiences, and any other services provided by Tribal Minds (collectively, the “Services”). By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree, you may not use our Services.

Tribal Minds Services connect people across the world—online and offline—for governance training, advocacy, ceremony, cultural revitalization, community wellness, and Indigenous-led economic development. Depending on how you engage with us, additional rules may apply:

  • House Rules for Everyone → These Terms, our Privacy Policy, and our Anti-Discrimination Policy.
  • House Rules for Sellers → If you list or sell any items, products, or services through our platforms.
  • House Rules for Buyers → If you browse, shop, or purchase through our Services.
  • House Rules for Third Parties → These apply to intellectual property owners, Tribal Minds affiliates, API users, or anyone requesting information.

All of these policies are part of our Terms, so please read the ones relevant to you.

 

Your Privacy

Your privacy matters. Our Privacy Policy explains how your information is collected, stored, and used when you engage with our Services. By using our Services, you agree to how we process information as set forth in the Privacy Policy.

Where applicable, you may also be bound by third-party privacy rules (for example, vendors, affiliates, or event partners). You agree to indemnify Tribal Minds if your actions cause us liability under joint data controller rules.

 

Your Account with Tribal Minds

  • You must be 18 years or older to create an account. Minors ages 13–17 may participate only with guardian supervision. Children under 13 may only participate with direct parental/guardian involvement.
  • Provide accurate information about yourself. Impersonation or false information is prohibited.
  • You are solely responsible for all account activity, including activity of minors under your account.
  • Protect your password. You are fully responsible for keeping your account secure.
  • These Terms do not create an employment, agency, or partnership relationship with Tribal Minds.

 

Your Content

Anything you post through our Services is Your Content. You remain its owner, but you grant Tribal Minds a broad license to use, display, and distribute it as needed to provide Services and promote our mission.

By posting Your Content, you grant Tribal Minds a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, modify, distribute, and display it across media channels. This includes cultural materials (songs, images, prayers, or language recordings) that you voluntarily share.

You are solely responsible for Your Content and agree not to post anything infringing, harmful, abusive, false, or misleading.

 

Your Use of Our Services

You are granted a limited, non-exclusive, revocable license to use our Services. In exchange, you agree:

  • Not to violate any laws (local, state, tribal, federal, or international).
  • Not to infringe upon, misappropriate, or misuse Indigenous cultural knowledge, ceremonies, rituals, or languages shared through our Services.
  • Not to exploit, commodify, or replicate cultural or spiritual practices without consent.
  • Not to interfere with or disrupt our Services (hacking, viruses, scraping, etc.).
  • To respect our Tribal Minds trademarks and intellectual property.
  • To share suggestions or ideas with the understanding they may be used freely by Tribal Minds.

 

Termination

  • You may close your account at any time.
  • Tribal Minds may suspend or terminate your account if you violate the Terms.
  • Tribal Minds may change, suspend, or discontinue Services at any time.
  • Certain provisions (e.g., liability, indemnification) survive termination.

 

Warranties and Limitation of Liability

Tribal Minds offers Services “as is.” We make no warranties or guarantees about results, outcomes, or availability.

This includes:

  • Ceremonies and Cultural Practices: Offered for educational, cultural, and community purposes only. They are not medical, psychological, or legal treatment.
  • Indigenous Languages: Shared for revitalization and cultural purposes, not for commercial exploitation.
  • Advocacy & Governance Training: Shared as educational resources, not as binding legal or financial advice.

Tribal Minds, its officers, staff, cultural practitioners, and affiliates are not liable for damages (direct, indirect, incidental, or consequential) exceeding $100 or the amount you paid in the past 12 months, whichever is greater.

 

Indemnification (or What Happens If You Get Us Sued)

If your actions (online or in-person) cause Tribal Minds to be sued, you agree to indemnify and hold us harmless. This includes but is not limited to: misuse of ceremonies, misrepresentation of cultural knowledge, intellectual property claims, or violations of law.

 

Disputes with Tribal Minds

Any disputes will be governed by Nevada law and resolved through binding arbitration in Washoe County, Nevada (unless otherwise specified). Class actions and representative claims are waived.

 

Changes to the Terms

We may update these Terms from time to time. Continued use of Services after updates means you accept the changes.

 

 Some Finer Legal Points

  • If any section is unenforceable, the rest remains intact.
  • Our failure to enforce is not a waiver of rights.
  • We may assign rights and obligations under these Terms.
